Purchase of Service Credit (PSC) Update-Class Certification Denied-Opportunity for New Litigants to Join Our Case
As you know, MEA currently has a lawsuit filed against SDCERS for causes of breaches of fiduciary related to the purchase of service credit (PSC) “correction” process. On October 31st, 2013, the Court denied Michael Conger’s motion to certify the case as a class action lawsuit. Although this does not affect the 356 litigants who Ann Smith represents on behalf of MEA, it does provide an opportunity to add any retiree, active or former employee who had not previously signed up to be represented in the PSC lawsuit.
If you know of anyone who was affected by the PSC “correction” process who is not a current litigant, please let them know that MEA is briefly allowing more litigants to join the case on the same terms and conditions that applied to the current litigants when they joined. To do so, the individual must email Lora Folsom (psclitigation@sdmea.org) at MEA, not Ann Smith’s law firm (due to the anticipated high volume, please email instead of calling Lora). Please note that you cannot email Lora or anyone else regarding the PSC lawsuit from your City email address. After emailing Lora, individuals interested in joining the lawsuit will be asked to complete paperwork, to provide specific documents and to pay their administrative fee. Everything (including the payment) must be submitted no later than 4:30 p.m. on Tuesday, December 17th. There will be no extensions or exceptions for any late submittals.
