Update Regarding MEA’s PERB Challenge to Proposition B
As you know, in July the Public Employment Relations Board (PERB) held a hearing on MEA’s Unfair Practice Charge (UPC) challenging the City’s failure to meet and confer with MEA over the Comprehensive Pension Reform (CPR) ballot initiative (Proposition B). Based on Mayor Sanders’ entire course of conduct with regard to Proposition B, the thrust of MEA’s UPC is that it is the City’s initiative (not a bona fide “citizens’ initiative”), and therefore required negotiations with recognized employee organizations before being placed on the ballot. The evidence presented at the hearing in July—including the direct testimony of Mayor Sanders—overwhelmingly supported MEA’s allegations, and now we await the ruling from PERB’s Administrative Law Judge on our UPC. The ruling is expected to be issued in December.
In the meantime, MEA counsel Ann smith has filed a post-hearing brief and a reply brief responding to the City’s arguments. Both documents are attached. They are long but they are worth the time to read if you have an appetite for legal filings and are interested in the details of the case!
